Fine of 200 thousand rubles and fence dismantling. Verkhneuslon District Court upheld decision of environmentalists

To provide free access of citizens to the water body, the Verkhneuslon enterprise Tatkrakhmalpatoka was ordered to dismantle the fence. The relevant decision was issued by the Verkhneuslon District Court. Illegal construction on the bank of the Sulitsa River was identified by the inspectors of the Central Territorial Administration of the Ministry of Ecology and Natural Resources of the Republic of Tatarstan. For the fact of unauthorized seizure of the shoreline environmentalists brought the violator to administrative responsibility in the form of a fine of 200 thousand rubles under art. 8.12.1 of the Code of Administrative Offenses of the Russian Federation: Non-compliance with the provision of free access of citizens to a public water body and its coastal strip. In addition, the inspectors of the CTA issued an order to the owner of this building to eliminate the violation. The enterprise disagreed with this conclusion and appealed the decision in Verkhneuslon district court. The court, having considered the case on limitation of free access to the reservoir, remained on the ecologists’ side.
