3 years long dispute. Supreme Court of Russia rejected all claims of Transneft-Prikamye to environmentalists

11 September 2017, Monday

Administrative fines for a total of 700 thousand RUR. Such a punishment will be incurred by Transneft-Prikamye for violations of environmental legislation. The final stop in the decision of this issue in favour of environmentalists was put by the Supreme Court of the Russian Federation. The administrative case was initiated by the inspectors of the South-Eastern Territorial Administration of the Ministry of Ecology and Natural Resources of the Republic of Tatarstan as early as 2014. Then, during the inspection of the Bugulma district in the recreation center Orlyonok, owned by the Transneft-Prikamye, the ecologists recorded the presence of holiday cottages that restricted the public access to the Karabash reservoir. On this fact, the inspector of the Southeast Administration drafted administrative reports under art. 8.12.1. of the Administrative Code of the Russian Federation (Non-compliance with the provision of free access of citizens to a public water body and its coastal strip) and Art. 8.45. of the Administrative Code of the Russian Federation (Failure to meet the requirements for the installation of economic and other facilities located within the boundaries of water protection zones, facilities ensuring the protection of water bodies from pollution, clogging, siltation and depletion of water). For these violations, Transneft-Prikamye was given an administrative fine for a total of 700,000 RUR. Disagreeing with the conclusion of environmentalists, the organization appealed the decision in the Bugulma City Court and the Supreme Court of the Republic of Tatarstan. However, the courts have supported the decision of the inspectors of the Southeast Administration. After that, on the initiative of violators, the dispute was considered in the Supreme Court of the Republic of Tatarstan and in the Supreme Court of the Russian Federation. Following the results of all the court hearings, Transneft-Prikamye was found guilty and will bear responsibility.
