Entrepreneurs are to submit reports on formation, use, deactivation and placement of waste before March 1st

According to Article 18 of the Federal Law “On production and consumption waste”, small and medium businesses, the activity whereof entails formation of waste, shouldn’t elaborate Waste Generation and Disposal Targets (WGDT), but they should submit reports on formation, use, deactivation and placement of waste to the authorized bodies by giving a notice (hereinafter referred to as Reports).  Small and medium businesses subject to the regional state ecological surveillance are to submit Reports to the Ministry of Ecology and Natural Resources of the Republic of Tatarstan (hereinafter referred to as the Ministry) on an annual basis before March 1st. The Ministry ensures acceptance and control of Reports through its local (territorial) departments. The information on territorial departments of the Ministry in charge of acceptance and control of Reports including addresses, telephones, e-mails, and public access plans are given in the Table (see Enclosure).

Small and medium businesses should send two copies of Reports in paper form with attachment of the copies of documents in e-form (with attachment of scanned images of documents) and an application addressed to the Head of the relevant territorial department of the Ministry directly to the territorial department, or it should be sent by post with the declared value at the time of mailing and a list of contents. A mark of the Ministry upon mail registration with the indication of the date of receipt is deemed the date of submission of Reports. Reports should be bound, sealed (if appropriate) and signed by the managing director of the reporting unit of small and medium enterprises (sole entrepreneur). Pages of Reports should bear consecutive numbering. The list of documents included into the Reports is subject to the requirements of the Administrative Regulations of the Ministry of Ecology and Natural Resources of the Republic of Tatarstan on rendering of the state service of acceptance of reports on formation, use, deactivation, and placement of waste (except for statistical reports), approved of by order of the Ministry of Ecology and Natural Resources of the Republic of Tatarstan as of April 23, 2012 under No. 148-п (revised on December 29, 2015).

 

 

Reports include:

1) general information on the reporting unit of small and medium enterprises;

2) mass balance of the formed, used, deactivated waste, as well as the waste transferred to other legal entities and sole entrepreneurs, the waste received from other legal entities and sole entrepreneurs or individuals during the reporting period;

3) the information on the legal entities and sole entrepreneurs, whereto the waste was transferred during the reporting period;

4) attachments including:

- details of the license for the activity on collection, transportation, processing, recycling, deactivation, and placement of waste of  hazard class I - IV – in case if the reporting unit of small and medium business carries out activity on collection, transportation, processing, recycling, deactivation, and placement of waste of  hazard class I - IV.

- copies of agreements on transfer of waste to other legal entities and sole entrepreneurs or on receipt of waste from other legal entities and sole entrepreneurs during the reporting period, as well as copies of the certificates on acceptance and transfer of waste subject to the indicated agreements. Copies of the specified agreements and certificates are to be sealed by the reporting unit of small and medium business;

- copies of the certificates on acceptance and transfer of  metal junk and ferrous and non-ferrous scrap metal;

- details of the license for the activity on collection, transportation, processing, recycling, deactivation, and placement of waste of  hazard class I – IV issued to the legal entities and sole entrepreneurs whereto the reporting unit of small and medium business transferred waste of  hazard class I – IV during the reporting period.

Should the users of natural resources referred to the units of small and medium business fail to fulfill their obligations with regard to timely submission of Reports on formation, recycling, deactivation, and placement of waste (except for statistical reports) to the authorized federal executive authorities or the executive authorities of the constituent unit of the Russian Federation, such users shall be held administratively liable subject to Article 8.2 of the Administrative Code of the Russian Federation (Federal Law as of December 30, 2001 No. 195-ФЗ), which is confirmed by the existing legal precedents (ruling of the Supreme Court of the Russian Federation as of June 6, 2014 No. 3-АД14-2, ruling of the Arbitration Court of Moscow District (Federal Arbitration Court of Moscow District) as of August 20, 2014 No. Ф-05-8666/2014 with regard to case No. 040-6935/2014, as of May 21, 2014 No. Ф05-3795/14 with regard to case No. А40-118751/2013, and as of February 4, 2014 No. Ф05-17059/2013 with regard to case No. А40-58722/13, as well as other court orders).
