Fines for absence of emission control systems to be introduced in Russia

Production enterprises and companies will be subject to penal sanctions for absence of systems for automatic control of emissions and discharges of pollutants, said Sergei Donskoy, the Minister of Natural Resources and Environment of the Russian Federation. The corresponding draft of amendments to the Code of the Russian Federation on Administrative Offenses was sent by the head of the environmental department to the Government of the Russian Federation. The document was introduced together with amendments to the Law on Environmental Protection in the part of automatic emission control. The draft law provides that the program for equipping stationary sources of discharges and discharges at Category I facilities is submitted as part of an application for a comprehensive environmental permit. The implementation of the program may not exceed 4 years from the date of obtaining a comprehensive environmental permit, except for cases involving the reconstruction or decommissioning of stationary sources.
The new draft law presupposes the introduction of responsibility for non-fulfillment or untimely fulfillment of requirements for equipping stationary sources of pollutant emissions, discharges of pollutants with automatic control systems. The amount of the administrative fine for officials will be from 20 to 40 thousand roubles; for legal entities – from 100 to 200 thousand roubles
For deliberate non-fulfillment or untimely performance of duties to provide information on the emission and discharge of pollutants obtained using automated control systems, liability is provided in the form of an administrative fine for officials in the amount of 10 to 20 thousand roubles; legal entities – from 50 to 100 thousand roubles.
Submission to the state register of objects that have a negative impact on the environment, inaccurate information on the emission and discharge of pollutants obtained using automated control systems will entail an administrative penalty for officials in the amount of 15 to 30 thousand roubles; legal entities – from 100 to 200 thousand roubles.
Also, the article contains a note stating that a person carrying out entrepreneurial activities without the formation of a legal entity bears administrative responsibility as a legal entity.
Consideration of cases of administrative violations by state environmental supervision bodies is expected to be carried out within the framework of the established powers for control and supervisory activities.
